Credit Reporting Policy and Statement of Notifiable Matters

1. About this policy

Adheseal Pty Ltd ACN 010 441 013 (Adheseal, we, us, our) recognises the importance of protecting personal information.

This Credit Reporting Policy explains how we collect, hold, use, disclose and otherwise handle credit-related personal information in connection with commercial credit. It also includes our Statement of Notifiable Matters under the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code.

2. What credit-related information we collect

If you apply for, or are connected with, commercial credit from us (for example as a customer, director, partner, trustee or guarantor), we may collect and hold credit-related information, including:

  • identification and contact details;
  • details of your credit application;
  • information about your commercial credit arrangements with us;
  • payment history information and information about overdue payments;
  • publicly available information relevant to creditworthiness;
  • credit information, credit eligibility information and other credit-related personal information as those terms are used in the Privacy Act.

3. How we collect credit-related information

We generally collect credit-related information:

  • directly from you (including through forms, correspondence, telephone and email communications);
  • from persons acting on your behalf;
  • from credit reporting bodies;
  • from trade references and other credit providers (where permitted by law);
  • from publicly available sources and other lawful sources.

4. Why we collect, use and disclose credit-related information

We collect, use and disclose credit-related information for purposes connected with commercial credit, including to:

  • assess applications for commercial credit;
  • verify identity and creditworthiness;
  • review and manage existing credit facilities;
  • assess applications relating to credit guarantees;
  • manage credit risk and recover debts;
  • report payment defaults and other credit-related information where permitted by law;
  • comply with legal and regulatory obligations.

5. Disclosure of credit-related information

We may disclose credit-related information, where permitted by law, to:

  • credit reporting bodies;
  • trade credit bureaux;
  • other credit providers;
  • our professional advisers (for example legal, audit and compliance advisers);
  • debt collection agencies and dispute resolution bodies;
  • courts, tribunals, regulators and law enforcement bodies;
  • other parties where disclosure is authorised or required by law.

7. Overseas disclosures

We may disclose credit-related information to overseas recipients where permitted by law, including where service providers used by us or credit reporting bodies operate outside Australia.

8. Access and correction

You may request access to credit-related personal information we hold about you, and you may request correction if you believe information is inaccurate, out-of-date, incomplete, irrelevant or misleading.

We will respond to access and correction requests within a reasonable period and in accordance with applicable law.

9. Complaints

If you have a complaint about how we have handled your credit-related personal information, please contact us using the details below.

We will:

  • acknowledge your complaint within 7 days; and
  • aim to investigate and provide a written outcome within 30 days (unless a longer period is reasonably required and permitted by law).

If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) or an applicable external dispute resolution scheme.

10. Statement of Notifiable Matters

Under the Privacy Act and the Privacy (Credit Reporting) Code, we notify you that:

  • we may disclose your credit information to credit reporting bodies listed in this policy;
  • credit reporting bodies may include that information in reports provided to other credit providers to assist them to assess your creditworthiness;
  • if you fail to meet payment obligations, we may disclose this to a credit reporting body as permitted by law;
  • you have rights to request access to, and correction of, credit-related information we hold about you;
  • you can make a complaint about how we handle your credit-related information;
  • you can ask a credit reporting body not to use your credit reporting information for pre-screening of direct marketing by a credit provider; and
  • you can ask a credit reporting body not to use or disclose your credit reporting information if you believe on reasonable grounds that you are, or are likely to become, a victim of fraud.
